Academies

Both during the process of conversion to academy status, and subsequently, the range of new legal and regulatory requirements faced by governing bodies and leadership teams can appear daunting.

At Spearing Waite we recognise these concerns. We are an East Midlands firm and a number of our partners and employees are themselves governors of local schools and academies, with personal experience of the issues involved.

With this in mind, we offer a “hands on” service tailored to the particular needs of each academy client. Our academies team includes specialists from our employment, corporate, business services and commercial property teams and we understand that when difficult issues arise, you need friendly and professional advice from trusted advisers.

Key areas where we provide assistance to academies include:

  • Employment contract and policy reviews, assistance with absence, grievance and disciplinary issues, recruitment support and advice on TUPE transfers and changing terms and conditions.
  • Comprehensive advice on contractual arrangements, including terms and conditions of purchase and supply, in order to allow academies to maximise the benefits of their independent status.
  • Assistance with all aspects of information law, ranging from freedom of information requests to compliance with data protection legislation.
  • Practical advice and training to ensure that academies benefit from a constructive and clearly defined relationship between an effective governing body and a strong leadership team.
  • Planning and construction advice, assistance with acquisitions and disposals of land and buildings, property disputes and litigation and property finance.

We understand that the requirements of each academy are different and that a single “standard” legal support package is therefore unlikely to meet these needs.

Our aim is to identify at the outset the areas where legal support is needed and to tailor our service accordingly. This approach ensures that each client is treated as an individual and is able benefit from high quality legal advice, structured in way which meets their specific needs.

As part of this process, fee structures, including fixed fee arrangements, can be agreed in advance to ensure that academies receive the best advice without an unexpected sting in the tail when the invoice arrives.
